The state investigators determined that the nursing home "failed to ensure a Summary of the Investigation of Abuse was reported to the State Agency (California Department of Public Health) within the required five working days of the incident. This deficient practice failed to ensure a complete investigation of an abuse incident was conducted and had the potential for abuse to continue."
The state investigators reviewed the Facility-Reported Incident indicating that two residents "were eating lunch in the dining room." At that time, one resident sat at the same table with the other resident who "became upset and made a comment that he would be able to trip [the first resident's] wheelchair." The first resident responded by using profanity toward the second resident.
The investigators interviewed the first resident, who stated that "they were eating lunch and [the verbally aggressive resident] told her to move." The female resident reported that the aggressive resident said, "I'll kick your butt."
The assaulted resident stated that "she was scared and felt [the aggressive resident] was a threat to her life." The investigators saw the aggressive resident "walking in the hallway with staff." When asked, the aggressive resident "declined to make an appointment for an interview." The facility Administrator verified that "the alleged abuse between [the residents] was a verbal altercation," but "there was no physical contact."
The facility "failed to assess the resident's risk for falls, including the need for supervision and assistive devices, implement measures to prevent risks for falls, and monitor the effectiveness of fall prevention activities." This failure "had the potential to expose [one resident] to an environment with an increased risk for falls, resulting in injuries from avoidable accidents."
The resident "was concerned that she was going to fall again at the facility because she was dizzy at the time she fell and did not remember how she fell at home." A Certified Nursing Assistant stated that the resident "was a newly admitted resident in the facility [and staff] had not informed them how to implement fall precautions to prevent future falls."
